B: CONTRACTUAL OBLIGATIONS

1. Critera: Project services
· "The Grant Recipient [Firm Foundation] will perform this Agreement in accordance with ... Narrative." (Contract Agreement, # 1.b., NTRPDC, < B1-6>)
· "The Contractor [Firm Foundation] shall perform all of the Project services described in the subgrant application attached hereto." (Contract Agreement, # 1, PCCD 1st year application, < B2-27>)
Performance: Firm Foundation
· Salaries were paid to an Executive Director, Supervising Trainer, Construction Trainer, and Life Skills Specialist as budgeted. Everybody got their paychecks, but we found no documentation to show who did what.
· Except for limited construction training, most of the contracted services (as detailed below) were not implemented by Firm Foundation for either the NTRPDC or Bradford County PCCD grants.

2. Criteria: Invoice from Contractor
· "Payment for services rendered and allowable expenses and costs incurred shall be made ... monthly upon receipt of the invoice from the Contractor [Firm Foundation]." (Contract Agreement, # 3, PCCD 1st year application, < B2-27> )
· "The Contractor [Firm Foundation] shall maintain adequate fiscal controls to insure that charges to Project funds are for allowable costs as provided for in the approved project and that documentation is readily available to verify the accuracy of such charges." (Contract Agreement, # 7, PCCD 1st year application, < B2-28> )
Performance: Firm Foundation
· Firm Foundation did not provide invoicing for payment or documentation to verify expenditures. (Also see "Section Five: Oversight, (6) Criteria: Payment disbursal")
· Upon BCAD's inquiries, when records were not available through the Firm Foundation office (at Career Link), Wayne Blow agreed to gather documents for review and to provide contact information for followup interviews. However, he did not provide these as he promised, and he subsequently stopped returning our phone calls.

3. Criteria: Community meetings
· ". . . the program will leverage support from others in the community . . ." (Proposal Narrative, NTRPDC, < B1-35>)
· "This will be accomplished mainly through community meetings . . ." (Project Narrative, PCCD 1st yr Application, < B2-7>)
Performance: Firm Foundation
· Wayne Blow said there have been no community meetings beyond those listed in the first quarter of the NTRPDC grant period. He stated there were no community meetings during the PCCD grant period.

4. Criteria: Number of inmate/trainees
· "The program's initial goal is to serve 10 participants over each 10-week session... (Proposal Narrative, NTRPDC, < B1-36>, and Project Narrative, PCCD 1st yr Application, < B2-5>)
· "Project Objective: Inmate participation and completion of life skills training and on-the-job employment skills training. ... Measured at the end of this subgrant period: Planned 40 inmates participating/40 inmates completing." (Project Assessment Plan, PCCD 1st yr Application < B2-9>)
Performance: Firm Foundation
· Over a period covering BOTH grants (Jan 03 thru May 04), a total of 10 inmate/trainees (vs the 40 or more planned for) were involved in the program. However, Firm Foundation has not provided requested documentation to confirm these numbers or actual dates worked. (Bradford County Action (BCA) records 8 trainees, and Bradford County Correctional Facility (BCCF) lists 10 inmates thru June 11, 04. Of those 10, one quit and one was removed from the program prior to completion.)

5. Criterion: Life skills training
· "Life skills training (anger management, conflict resolution, responsible fatherhood and relationship building are a few of the topics covered) will be provided in conjunction with the existing programs at the current facility and in the community." (Proposal Narrative, NTRPDC, < B1-36>, and Project Narrative, PCCD 1st yr Application, < B2-5>)
Performance: Firm Foundation
· There are no records to verify that these training programs are ongoing, or how many inmates may have participated in these in the past.
· Firm Foundation Executive Director Wayne Blow stated that Wayne Beeman taught a class, but when funding was exhausted, they discontinued his job. He stated that the position would be a volunteer one in the next grant cycle.
· Corrections Counselor Lionel Hyatt indicated the programs available at the prison were fewer than indicated, were further reduced in June due to lack of funding, and were most often scheduled during the same hours as the work release hours so inmates had to choose between programs OR work release. He also noted that none of the prison training programs are open to inmates after they are released from prison.

6. Criteria: Mentoring
· "One-on-one mentoring will exist during the training and for one year after the individual's release." (NTRPDC Proposal Narrative, NTRPDC, < B1-36>, and Project Narrative, PCCD 1st yr Application, < B2-5,6>)
· "Firm Foundation provides on-the-job construction training, classroom training and mentoring..." (Project Narrative, PCCD 1st yr Application, < B2-6>)
· "... After leaving the program, the mentoring process continues . . ." (Proposal Narrative, NTRPDC, < B1-35>, and Project Narrative, PCCD 1st yr Application, < B2-8>)
· Similar references to mentoring were restated repeatedly throughout all grant contracts.
Performance: Firm Foundation
· Per conversations with Wayne Blow and Lionel Hyatt, there is no mentoring program.

7. Criterion: Background checks
· "All mentors and contractors will have background checks and have completed existing mentor-training program . . ." (Proposal Narrative, NTRPDC, < B1-36,37>, and Project Narrative, PCCD 1st yr Application, < B2-6>)
Performance: Firm Foundation
· There are no records to indicate that background checks or training were ever done. Wayne Blow stated Lionel Hyatt was responsible for approval; Lionel Hyatt stated there is no program.

8. Criterion: Services to inmate families
· "Provide services to inmate families" (Activity Plan and Schedule, PCCD 1st yr Application, < B2-10>)
Performance: Firm Foundation
· There are none.

9. Criteria: Follow-up services for a year
· "Follow-up services will exist for at least a year as the mentor[sic] continue mentoring and serve as a liaison to support services..." (Project Narrative, PCCD 1st yr Application, < B2-6>)
· "... and will track the employment and living standards status of each individual for at least a one-year timeframe." (Proposal Narrative, NTRPDC, < B1-35>, and Project Narrative, PCCD 1st yr Application, < B2-8>)
Performance: Firm Foundation
· Wayne Blow, Executive Director of Firm Foundation, stated that follow-up has not happened.

10. Criterion: Program progress evaluation
· "The program progress will be evaluated on a continuous basis with weekly testing and charting of progress. Statistical measurements will be monitored..." (Proposal Narrative, NTRPDC, < B1-35>, and Project Narrative, PCCD 1st yr Application, < B2-8>)
Performance: Firm Foundation
· There are no records available. Wayne Blow indicated the Site Manager (David Cortland) kept those records; David Cortland indicated he does no paperwork, only the onsite training.
